I think for Liam it's more than just about the hangover. It's about being talked down by Noel almost his whole carreer. And now he has lawsuit material so he goes for it. It's a statement. It's vindictive.

Noel never said the argument in Paris was about Pretty Green. It was about "Noel controlling the press in England" and making people believe it was Liam being irresponsible for not turning up.
Question: Can laryngitis be caused or exacerbated by dehydration from drinking/smoking?

That would make it even lamer. Liam has absolutely no connection to Noel now. They don't speak. He doesn't sing his songs. They're not in the same band. Noel can't tell him to do anything he doesn't want to do.
If Liam has been talked down to by Noel his entire career, he should feel fucking liberated that he has no connection to him and move on with his new band.
So what you're saying is that he's filing a lawsuit to say "I'LL SHOW YOU WHO'S BOSS! THIS IS FOR TELLING ALL THOSE AMUSING ANECDOTES ABOUT ME FROM 1994-2009"?

Why people like NL4E are going mental and bordering on mental breakdowns is beyond me. If Noel has lied about Liam then he has every right to sue but whatever, i don't care. I find the whole thing rather amusing and it is clearly just a big publicity stunt, making certain people's reactions on here even more pathetic and embarrassing. As I say it's just rock 'n' roll.

You would have to show that Noel made that comment with malicious intent, which is hard to prove. And you would have to show that there were damages involved - monetary, reputation, etc. Again, very difficult, isn't it in this case? Additionally, celebrities don't get the protection of libel that regular people do. But then again, maybe in England it's different. Irregardless, I lost a lot of respect for Liam here. It's pathetic. "Oh poor me, I was sick and Noel said I had a hangover. Woe is me." Sad. What is he, a five year old? And perhaps a hangover helped cause his condition, what then? This is nonsense. You need to Google English defamation laws. Burden of proof now sits with the defendant - Noel - to prove his statement's truth - that Liam was hungover and was not appropriately medically assessed. Defences are privilege of speech (not applicable as Noel was neither in court nor in parliament), justification (Noel proving that Liam was indeed professionally negligent) or fair comment (this was a reasonable comment that a reasonable person could have held). The appropriateness of the latter is going to be difficult to argue due to the existence of the doctor's note. Whether you personally morally approve or not, Liam is absolutely within his rights here. Certainly the burden of proof of the truth of the statement lies with Noel. And Liam has a great case with that. But to suing for money surely requires that the wronged party shows damages does it not? And that burden lies with the accuser. Someone needs to to tell Liam that he didn't have a spotless reputation for professionalism because of HIS OWN behaviour for years. Noel can easily argue that even if the statement was false that it did no additional damage to the reputation of Liam. Liam hasn't lost any money from this presumably. You can't sue someone for hurt feelings...well you can...but you shouldn't be getting money for it. Noel could still argue it was true as it is possible to have a hangover and have laryngitis @ the same time. The fact is that Liam was out drinking and hollaring the night before so Noel has a case as well. The fact is that as long as Noel had reckless disregard for the truth and malice intended Liam isn't going to win. And the fact is that Noel does have grounds for thinking that the laryngitis thing may not have been truthful. He might be wrong about that...but does he have reason for believing what he said? When he said it did he think it was true? I blame the people around Liam that let him think this wa a good idea. That he is so deserving of an apology and it so on the incontrovertible moral highground that he should rake them all through the mud. I blame the lawyers and everyone in his life that told him that he wasn't wrong to do this. That he deserves money for that comment.

noel has had an exclusive Q & A session this week in The Sun and an 2 page interview today in there.
Who did Liam release his exclusive statement to? The sun.
Noel also been on different radio station, a sky sports interview etc etc its all just promotion for the single.
They will 'settle out of court' and all be forgotten

To collect punitive damages, all individuals must prove actual malice.
An allowable defense in England is:
Fair comment on a matter of public interest - arguments made with an honest belief in their soundness on a matter of public interest (such as regarding official acts) are defendable against a defamation claim, even if such arguments are logically unsound; if a reasonable person could honestly entertain such an opinion, the statement is protected.
There is no way Liam will win this.
If Noel can prove that a reasonable person could believe that the cancellation had anything to do with a hangover when Liam had been out drinking the night then his statement is protected.

Noel himself has taken legal action to make journalists write retractions on false claims, so why is it any different that Liam is doing the same thing to Noel? It's fair enough I think.

No. All Noel would have to do if ordered to give one is put on a droll voice and quirk an eyebrow while he said it and it would bring Liam absolutely no peace. Also...if this is publicity stunt...I think they are morons. Their biggest hurdle to people concentrating on their music (which I do believe they both want) is people thinking they are moronic battling knobs. SO WAY TO GO GALLAGHERS ON PROVING THAT YOU ARE HEADLINE HUNGRY ATTENTION WHORES. It may sell records...but using the tactics of reality show stars is really disgusting. And if they were really working together on this Noel should have been piping up around the BDI release and getting them headlines.

All that will end on this score---if it continues----will be an OTT , tearful, corny onstage live reunion of the Gallagher duo, with gullible suckers paying PLENTY to witness the 'spectacle' at some mega outdoor arena, with huge screens etc.
It all sounds terrible. Even Lennon and Macca never stooped to this in the early 70s....... and they had much more to gripe about than this trivial twaddle.
Lennon put his thoughts about Mc Cartney in song 'How do you sleep?' and that was the best way to respond to a previous band soulmate, rather than this tedious tabloid trash.

(A) laryngitis after staying in bed and reading the Bible the night before (B) laryngitis and a hangover after smoking twleve packs of Camels and gargling Jack Daniels all night (C) a hangover with his voice as pure as the day he recorded Cast No Shadow
Yes, there are frivilous lawsuits filed in the US (and canada) every day. Gotta tell, you, as a lawyer, it is fucking annoying see trials delayed for months because the courts are bound up with garbage like this.
